Transcript: Intel top execs failed to retain antitrust memos

The U.K's Inquirer and The Register are both reporting on a 58-page court filing (PDF) released this weekend that reveals Intel's top execs may have been playing "Hide and Seek the Antitrust E-mails."

According to the documents, Intel's chairman Craig Barrett, CEO Paul Otellini, and sales chief Sean Maloney are on the list of employees believed to have deleted e-mails relevant to a lawsuit filed by Advanced Micro Devices.

As reported recently by CNET News.com, Santa Clara, Calif.-based Intel had already disclosed that it failed to preserve some documents related to AMD's 2005 antitrust suit against it. The lawsuit alleges that Intel used the selective distribution of rebates to prevent certain customers from using AMD's chips.

According to our previous report, Intel had said human error allowed documents--mainly e-mails--to slip through the cracks of a manual document-retention system put in place after AMD sued the larger chipmaker. Intel had instructed employees to move their e-mails from a PC to a hard drive. The company later admitted that some employees failed to follow these procedures. What was unknown until now, however, was that Intel's top brass were likely a part of that group.

According to a transcript quote from an AMD rep, Intel said that Otellini was "under the impression that IT was automatically backing up his email and so he did not need to retain them."

According to the Register, Intel is now looking through employee e-mail files to find duplications of lost conversations, and it hopes to find a number of the missing memos when it reviews a large backup made last year.

'Tiger team' to test foreign software

The Pentagon is fielding a task force charged with testing software developed overseas, according to a Defense Department official.

The “tiger team,” organized within the Defense CIO’s office, is ready to move to the implementation stage, said Kristen Baldwin, deputy director for software engineering and systems assurance in the Office of the Undersecretary of Defense for Acquisition, Technology, and Logistics. Baldwin spoke yesterday at the DHS-DOD Software Assurance Forum in Fairfax, Va.

“Tiger team” is a software-industry term for a group that conducts penetration testing to assess software security.

“Success means they understand where their focus needs to be and how to prioritize their efforts,” Baldwin said. “They understand the supply-chain impact on systems engineering, and are ready to move forward in an effort to mitigate assurance risk.”

DOD strategy calls for using “all-source information to characterize supplier threat,” Baldwin added.

In 2004, the Government Accountability Office, noting that the military relies increasingly on software and information systems for its weapons capabilities, found that “traditional DOD prime contractors are subcontracting more of their software development to lower-tier and sometimes nontraditional defense suppliers,” which use offshore locations and foreign companies for some software development. An ongoing Defense Science Board task force, convened in 2005, is studying the same issue.

Offshore software development poses vulnerabilities, “such as the insertion of malicious code by software developers,” but mitigating those risks has “not been adopted as practice within DOD,” the GAO concluded

Dealing with the impact of what the Pentagon dubs “the foreign influence on DOD software” will not involve a buy-American strategy, however. “Globalization is the reality we face,” Baldwin said. “We will continue to rely on a global supply chain” when acquiring software for the Department of Defense.

Age-related cognitive decline not inevitable

NEW YORK (Reuters Health) - One in 10 women will reach the age of 85 with their mental abilities completely intact, while another 58 percent will experience only minor reductions in their cognitive abilities, research shows.

According to the study, women who maintain their cognitive function are less likely to have health conditions like diabetes or high blood pressure, less likely to smoke, and more likely to drink moderately, They also have more robust social networks and an easier time with activities of daily living.

Dr. Deborah E. Barnes of the Veterans Affairs Medical Center in San Francisco and colleagues report their findings in the Journal of the American Geriatrics Society.

They note in their report that most research on mental function among older people has compared people with normal mental function to individuals with dementia, but few researchers have looked at how people with very good mental function may differ from those who experience some decline but are still within the normal range.

"There's lots of people who are really sharp until late in life and it's important to try to study that group and figure out what's going on," Barnes told Reuters Health.

To investigate, she and her colleagues analyzed data on 9,704 women participating in a study of osteoporotic fractures. The women were 72, on average, at the beginning of the study, and were followed for 15 years. At the study's outset and four more times during the study, the women were given a test of mental function called the Mini-Mental State Examination.

By the end of the study, 9 percent of the women had not suffered any decline in their cognitive abilities, while 58 percent had minor decline and 33 percent suffered major cognitive decline.

The difference between the women with no decline in mental function and those with moderate decline was small, Barnes noted. These individuals had experienced "very, very mild changes in their memory," she explained. "They were just not quite as sharp, basically."

The women who experienced no cognitive decline were nearly twice as likely to be free of diabetes compared to those who had a minor decline. They were also 20 percent more likely to have normal blood pressure, 70 percent more likely to be non-smokers and 20 percent more likely to be moderate drinkers.

And the women with completely intact mental function were 40 percent more likely to have no problems with activities of daily living, and 20 percent more likely to have strong social networks.

The findings can't prove that these factors are involved in sustaining women's mental function, Barnes noted. Nevertheless, she added, "all the things that we identified have been found to be associated with better health in general, so it makes sense that they would be associated with better brain health."
